Issuing out the directive during the hearing of the Committee on Thursday, August 17 in Government House Benin City, Hon.Justice Alero Edodo-Eruaga (Retd), Chairman of Committee, stated that while both the Petitioner and Respondent argued back and forth over alleged encroachment, the layout done by His Royal Majesty, Oba Erediauwa needed to be properly situated in the fray because it had all relevant title documents, including a document conveying the said portion as a gift to the Respondent.
The Petitioner, Chaplain Rev. Dr. Oriakhi Usinefo Davis had told the Committee that his land was not in the Oba’s Layout but however accused both the Respondent, Prince Aiwerioghene and Usinefo Omoregie, Youth Chairman and Jeffery Omosomwan, Ohen of Aruogba Community of encroaching into his space.
He stated that while the Prince had cut off 8feet of the Petitioner’s land to put fence, the Aruogba Commumity had also cut off 26feet to put road.
The Committee directed the parties to get all supporting documents and be ready to go to Edo-GIS with a view to ascertaining if the Aiwerioghenes actually went outside their space within the Oba’s Layout.
The Edo-GIS finding is also targeted at checking the Coordinates of the survey made by the Oba to see if the Petitioner’s land is within the Layout.
Meanwhile, the Committee had observed that the Petitioner had no survey plan.
The case has been adjourned till October 19.
