Benin City – Terms of settlement have been drafted and signed by parties in the case of Pa John Osarenkhoe Vs Osazumamwen Orhue, Odionwere of Obarenren Village and Uhunmwangho Agho, Okaghele of Obarenren village, case relating to illegal sale of land, land sold without authority.
This is while the Committee heard reports on Prosecution on five cases and on a matter for legal advice.
The Petitioner in the case mentioned above was glad about the recovery of his land and yesterday appeared before the Committee during its sitting in Government House Benin City to express appreciations for the resolution and peace that now reigned between him and the Petitioners.
The case, which was assigned to Team B for Investigation, had only made three appearances since it was incidented and scene visited before the settlement witnessed yesterday.
During investigation it was discovered that a parcel of land measuring 100ft by 100ft situate in Obarenren village, Ovia North East was sold to the Petitioner.
While the Petitioner mobilized to start working on the land, someone came out, claiming the land was his and Petitioner immediately rejected going ahead to work on the land and insisted on a genuine land as the Committee reprimanded the respondents and gave them timeline to make another land expressly available for the Petitioner.
The Respondents in their defense before the Committee had said they needed the land for communal use and assured to give the Petitioner a new land.
A second land was offered and the Petitioner went ahead to confirm ownership and to do a survey.
Parties resolved their differences and a resolution was drawn up by the Committee for parties to sign.
In the resolution, the Respondents acknowledged that the Petitioner actually owned the land encroached on, but that because they needed it for communal use they had to relocate him to another land, this time land measuring 100 by 200ft on a street behind the parcel of land in issue.
The resolution also stated that, “the Petitioner accepted the new location in the interest of peace and amity.”
The Plot Allotment Committee and other elders of the village have conveyed the new plot to the Petitioner with all deeds of conveyance to boot.
By that resolution, the case is deemed to have been closed yesterday.
