Benin City – Parties in the case between Kent Obasuyi and Osayande Okoro, aka Otutu on Tuesday, April 18 disagreed over report by the Edo-GIS, part of collective agreement reached during the previous hearing towards resolving land dispute between the two parties.
While the Petitioner had opted for the services of an independent surveyor, the Repondent, Chief Mrs Thelma Obasuyi on her part approved the findings from the Edo-GIS Report, stating that the Report was a true reflection of what she originally met on ground prior to the purchase of the land.
However, the Respondent dismissed the proposal by the Petitioner to proceed to get his own Surveyor, stating that she would not have implicit confidence on the outcome of report from that quarters.
Both parties however accepted that the Committee should take the responsibility of getting an Independent Surveyor without both parties being involved.
Both Petitioner and Respondent are disputing over ownership of a parcel of land measuring 100 feet by 200 feet, wherein the Petitioner was said to have buried his mother in a part of the disputed land.
The EDO-GIS is expected to use coordinates provided by the survey plans tendered by the two parties to confirm if the documents tendered by the parties are in regards to same or different lands.
The Edo-GIS Report however showed that both parcels of land are distinct from each other.
The Petitioner however could not accept the report, stating that it was not a true reflection of the physical structure on ground.
The Committee has therefore elected to nominate an Independent Surveyor who will go to the land and establish a coordinate and bring back report to the Committee. The case was adjourned till May 11 for further hearing.
In another development, the Committee has directed the Odionwere and elders of Obagie-Nevbosa Community to appear before it in the next sitting to clarify once and for all, their roles in the sale of same land to two parties.
In another case, a Petitioner, Mary Osaigbovo Egharevba Iyawe also appeared before the Committee, and in excitement, reported that she had been relocated to a new land and that all matters had been settled regarding the land dispute with the Respondent, Victor Aikoriogie Iyawe.
